PROCEDURAL AND SUBSTANTIVE ISSUES IN ATTORNEY REVIEW: DOING IT RIGHT! A Guide for Residential Real Estate

Every real estate sale starts out with a contract of sale. Most often in a residential real estate transaction the parties are brought together by a realtor who supplies the initial form agreement of sale between the parties. As the foundation for the purchase/sale, this fully executed document gives rise to the attorney review period.

In New Jersey the attorney review period is, at a minimum, three business days. During the review period, there are several issues and items that are discussed between the parties before the parties arrive at a binding enforceable contract. This seminar will discuss many of the procedural and substantive issues a real estate attorney may be faced with during the attorney review period.

Learn all of the issues and considerations you need to be aware of when entering into an attorney review, including:
• Need for a written document in New Jersey
• Purpose of attorney review
• Modifications to the initial contract
• Mortgage contingency clauses
• Inspection clauses
• Limitations on liability
• Title commitments
• Other concerns of the seller
• Other concerns of the buyer
              … and more!
