Asset preservation is an essential part of estate planning. In fact, over the years, planners
have utilized various methods to help clients protect their assets from potential creditors and preserve their wealth. Domestic Asset Protections Trusts (DAPTs) are one such tool. In common law jurisdictions such as New Jersey, a client cannot establish a self-settled trust. However, some states do recognize DAPTs and provide a way for clients to accomplish their estate planning goals, which include obtaining tax benefits and asset protection.
